These Terms describe the rules for accessing and using BuildPod OS. They are written to explain account access, platform responsibilities, service limits, subscriptions, AI-assisted features, and customer data responsibilities in clear language.
By accessing or using BuildPod OS, the customer and each authorized user agree to these Terms. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.
If an order form, subscription checkout, statement of work, or written agreement applies, those terms also apply to the extent they cover the service or commercial relationship.
BuildPod OS is operational software for jobs, assets, inventory, staging, maintenance, workforce, communications, finance/predictions, intake, and ATLAS-assisted workflows.
The platform helps organize operations, records, workflows, and decision support. It does not replace the customer’s responsibility to supervise work, comply with law, train employees, and make final business or safety decisions.
Customer retains ownership of customer data. BuildPod may process customer data to provide, maintain, support, secure, troubleshoot, improve, and administer the service.
Customer is responsible for the accuracy, legality, and appropriateness of data entered into BuildPod OS. BuildPod uses commercially reasonable safeguards, but no system can eliminate every security, availability, or data-loss risk.
Customer must not upload, submit, or direct BuildPod to process data that customer lacks the right or authority to use. Customer is responsible for employee, contractor, customer, and end-user notices or consents where required by law or its own policies.
Customer admins are responsible for configuring roles, permissions, and workspace access in a way that matches the customer’s operational and privacy obligations.
Customer should maintain exports or backups of records it needs for its own legal, accounting, compliance, archival, or operational obligations.
Fees, billing cycles, taxes, renewals, nonpayment, cancellation, and plan changes are governed by applicable checkout, order, subscription, or written terms. Billing information must be accurate.
Paid subscriptions may renew unless canceled according to applicable checkout or order terms. BuildPod may suspend or limit service for nonpayment, payment disputes, abuse, or security risk. Cancellation must not be hidden or intentionally harder than sign-up.
Early adopter pricing may be offered for a limited time. Unless a separate written agreement states otherwise, early adopter pricing is locked only for the stated offer period. After that period, BuildPod may move the subscription to then-current standard pricing with notice when practical.
Trial payments are generally non-refundable once access is activated, except where required by law or approved by BuildPod. If you convert to a paid subscription during the trial period, the trial payment may be credited toward your first paid month.
Failed payments, chargebacks, payment disputes, and expired payment methods may result in account notices, retry attempts, feature limits, suspension, or cancellation according to the applicable subscription terms. Taxes, duties, and similar government charges are the customer’s responsibility unless a written agreement states otherwise.
Plan upgrades, downgrades, seat changes, and feature changes may affect pricing, access, limits, billing cycle timing, and available functionality. Refunds are provided only where required by law or expressly stated in a written order, checkout, or subscription agreement.
Monthly subscription payments are generally non-refundable after the billing period begins, except where required by law or approved by BuildPod. You may cancel future renewals according to the cancellation process available in billing or support.
Referral credits are promotional account credits, not cash payments. Credits apply only when referred customers become and remain active paying customers. Referral credits may be capped, may expire, and may not reduce an invoice below $0 unless BuildPod expressly allows it.
Unless otherwise stated, cancellation takes effect at the end of the then-current billing cycle, and customers remain responsible for fees already incurred.
Billing state is controlled by BuildPod billing and subscription systems, not customer-editable organization settings.
BuildPod OS is continuously updated. Security, bug, performance, reliability, and data-integrity updates may be deployed without customer pre-approval.
Material workflow changes may be communicated through release notes, in-app notices, or admin notifications when practical. Standard customers may be asked to acknowledge notices, but acknowledgment is not approval or decline of the update.
Customers cannot decline security, reliability, or data-integrity updates. Enterprise release windows, staged rollouts, or version pinning may be offered separately in the future.
BuildPod helps coordinate work and records, but it does not inspect physical job sites, vehicles, equipment, facilities, aircraft, vessels, or field conditions. Customer remains responsible for OSHA, safety, licensing, regulatory, inspection, quality, customer approval, and job-completion obligations that apply to its business.
ATLAS and other AI-assisted features provide decision support, summaries, recommendations, drafts, explanations, and workflow assistance. AI outputs may be incomplete, inaccurate, delayed, biased, unsuitable, or based on incomplete data.
ATLAS may rely on database records, uploaded materials, user-provided instructions, integrations, and operational context that may be stale, missing, conflicting, or incomplete. Recommendations can change when source data changes.
Customer and authorized users remain responsible for reviewing outputs before relying on them. ATLAS is not a licensed attorney, accountant, engineer, safety inspector, compliance officer, medical provider, or other professional advisor.
Human approval is required for final customer, financial, safety, operational release, legal, or irreversible decisions unless a separate approved automation rule explicitly allows a bounded action. BuildPod may log AI interactions, prompts, responses, source references, tool calls, and approvals for safety, audit, troubleshooting, and improvement.

BuildPod may depend on third-party providers for hosting, database, payments, email, communications, AI, analytics, maps/weather, and other infrastructure. Third-party services may have their own terms and outages.
BuildPod is not responsible for third-party failures outside its reasonable control, but will use commercially reasonable efforts to manage provider relationships.
Beta, preview, and early-access features may be incomplete, unstable, changed, limited, or removed. Customer should not use beta features for production-critical reliance unless separately agreed.
BuildPod aims to provide reliable service. Unless a separate written SLA applies, no specific uptime or response-time guarantee is made. Maintenance, third-party outages, security issues, and force majeure may affect availability. More detail is available in Support & Service Levels.
Each party may receive non-public business or technical information. Confidential information should be used only for the relationship and protected with reasonable care. Confidentiality obligations do not apply to information that is public, independently developed, lawfully obtained without duty of confidence, or required to be disclosed by law.
BuildPod owns the software, platform, designs, workflows, and underlying technology. Customer owns customer data. Feedback may be used by BuildPod to improve the service without obligation unless separately agreed.
Customer may not copy, reverse engineer, resell, sublicense, distribute, or create derivative products from BuildPod except as allowed by law or agreement.
To the maximum extent permitted by law, the service is provided “as is” and “as available.” BuildPod disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement where allowed.
BuildPod does not guarantee uninterrupted, error-free, secure, or loss-free service, and does not guarantee AI outputs are correct, complete, or suitable.
To the maximum extent permitted by law, BuildPod is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost goodwill, business interruption, lost data, or cost of substitute services.
These limitations apply regardless of legal theory, including contract, tort, negligence, strict liability, warranty, statute, indemnity, or otherwise, to the maximum extent permitted by law.
BuildPod’s aggregate liability is capped at the greater of fees paid by customer to BuildPod for the service in the three months before the event giving rise to the claim or $100 if no fees were paid. Some jurisdictions do not allow certain limitations, so these limitations apply to the maximum extent permitted.
Customer agrees to defend and indemnify BuildPod from claims arising from customer data/content, misuse of the service, violation of law, unauthorized use caused by customer’s failure to manage users or credentials, or use contrary to these Terms. BuildPod may control defense where legally appropriate.
BuildPod may suspend or restrict access for nonpayment, security threat, abusive use, legal risk, violation of terms, or harm to the platform or other customers. Customer may cancel according to subscription terms.
Data export and retention after termination are governed by the Data & Processing policy. Some obligations survive termination.
Unless a separate written agreement states otherwise, the governing law and dispute forum will be specified in the applicable order form or customer agreement. If no such agreement applies, BuildPod may designate governing law in its customer-facing order or subscription terms.
